1. Who we are
This website (netaye.com, the Site) is operated by Netaye NZ Limited, a company incorporated in New Zealand, NZBN 9429050794836 ("Netaye", "we", "us", "our").
We are the "agency" responsible for your personal information under the New Zealand Privacy Act 2020, and we handle it in accordance with the information privacy principles (IPPs) in that Act.

2. What this policy covers
This policy explains what personal information we collect through the Site, why we collect it, who we share it with, how long we keep it and what rights you have. It applies to the Site and to our waitlist and email communications. It does not apply to third-party websites we link to, which have their own policies.
By using the Site you also agree to our Terms of Use and Cookie Policy.
3. Information we collect
3.1 Information you give us
- Waitlist and sign-up details — your email address, and (if the form asks for them) your name, company or role, and any message or free-text you choose to include.
- Correspondence — the content of emails or messages you send us, and our replies.
Providing this information is voluntary. If you do not provide your email address we cannot add you to the waitlist or contact you about the product.
3.2 Information collected automatically
When you visit the Site, our hosting and content-delivery providers automatically record technical information, which may include your IP address, approximate location derived from it, browser and device type, operating system, referring page, and the pages and times you accessed. This is used for security, abuse prevention, and to keep the Site working.

3.3 Information we do not collect
We do not knowingly collect payment card details, government identifiers, health information, or any other sensitive category of information through this Site. Please do not send us that information.

Under the Privacy Act 2020 we collect personal information only for these lawful purposes connected with our functions, and only where collection is necessary for those purposes (IPP 1).
5. We do not sell your information
We do not sell, rent or trade personal information, and we do not share it with third parties for their own marketing.
6. Who we share it with
We share personal information only with the service providers we need to run the Site and our waitlist. They act on our instructions, hold the information on our behalf, and are not permitted to use it for their own purposes. We describe them by category below rather than by name, because the specific tools we use may change:

We may also disclose personal information where we are required or permitted to by law, to a regulator or law enforcement agency, to our professional advisers, or to a buyer or successor if we sell or restructure our business (in which case this policy will continue to apply to the information transferred).
7. Storing and sending information overseas
We operate from New Zealand, but some of our service providers are located overseas, including in the United States. This means your personal information will be stored and processed outside New Zealand.
Where IPP 12 of the Privacy Act 2020 applies, we only disclose personal information to a foreign person or entity where we reasonably believe the recipient is subject to privacy safeguards comparable to those in the Privacy Act — for example through binding contractual terms with our providers — or where another ground in IPP 12 applies.

8. How long we keep it
- Waitlist details — until you unsubscribe or ask us to delete them, or until 24 months after the waitlist closes or you last engaged with our emails, whichever comes first.
- Correspondence — up to 24 months after the matter is closed, unless we need it longer for a legal claim.
- Server and security logs — for the period set by each provider, typically no more than 12 months.
We do not keep personal information for longer than is required for the purposes it may lawfully be used for (IPP 9). After that we delete it or irreversibly aggregate it.
9. Security
We take reasonable safeguards to protect personal information against loss, misuse and unauthorised access, use, modification or disclosure (IPP 5). These include using reputable providers that encrypt data in transit (HTTPS/TLS) and at rest, limiting who can access the waitlist, and using strong authentication on our accounts.
No method of transmission or storage is completely secure. If a privacy breach occurs that has caused or is likely to cause serious harm, we will notify the Office of the Privacy Commissioner and the affected individuals as required by Part 6 of the Privacy Act 2020.
10. Your rights and choices
- Unsubscribe — every marketing email includes an unsubscribe link, and you can email us at any time to be removed.
- Access — ask what personal information we hold about you and get a copy.
- Correction — ask us to correct information that is wrong, incomplete or out of date. If we do not correct it, you can ask us to attach a statement of the correction sought.
Your access and correction rights are given by IPPs 6 and 7 of the Privacy Act 2020. We will respond as soon as reasonably practicable, and no later than 20 working days after we receive your request.
How to exercise your rights
Email [email protected] from the address you signed up with, or tell us enough for us to identify you. We may ask you to verify your identity. There is no charge for a reasonable request; we will tell you first if a charge would apply.
11. Marketing emails
We only send marketing email to people who have asked to hear from us. Our messages identify Netaye NZ Limited as the sender and include a working unsubscribe facility, as required by the New Zealand Unsolicited Electronic Messages Act 2007. We action unsubscribe requests promptly and in any case within 5 working days.
12. Children
The Site is not directed at children and we do not knowingly collect personal information from anyone under 16. If you believe a child has given us their information, email [email protected] and we will delete it.
13. Links to other sites
The Site may link to third-party websites and services. We are not responsible for their content or privacy practices — please read their policies before providing them with your information.
14. Changes to this policy
We may update this policy as our product and our data practices change. The "Last updated" date at the top shows the current version. If a change materially affects how we use information you have already given us, we will tell you by email or a prominent notice on the Site before it takes effect.

1. These terms
These Terms of Use ("Terms") govern your access to and use of netaye.com and any page, form or content on it (the "Site"). The Site is operated by Netaye NZ Limited, a New Zealand company, NZBN 9429050794836 ("Netaye", "we", "us", "our").
By accessing or using the Site, or by joining our waitlist, you agree to these Terms. If you do not agree, please do not use the Site.
Our Privacy Policy and Cookie Policy form part of these Terms.
2. Who may use the Site
You must be at least 16 years old to use the Site or join the waitlist. If you use the Site on behalf of an organisation, you confirm you are authorised to bind that organisation to these Terms, and "you" means both you and that organisation.
3. The Site is informational
The Site describes a product that is in early access. Nothing on the Site is an offer capable of acceptance, a commitment to build or release any feature, or a contract to supply any product or service. Content on the Site — including descriptions, timelines, screenshots and pricing indications — is provided for general information, may be forward-looking, and may change or be withdrawn at any time without notice.
Nothing on the Site is professional, legal, financial or technical advice, and you should not rely on it as such.
4. Joining the waitlist
- You must give accurate contact details and only submit an email address you own or are authorised to use.
- Joining the waitlist does not entitle you to access the product, to a place in any queue, or to any particular price or terms.
- We may invite waitlist members to access the product in any order we choose, may limit numbers, and may decline or remove any registration at our discretion.
- If and when the product becomes available, its use will be governed by a separate agreement which you will need to accept at that time.
- You can leave the waitlist at any time using the unsubscribe link in our emails or by emailing [email protected].
5. Acceptable use
You must not:
- use the Site for any unlawful purpose, or in breach of any applicable law;
- submit false, misleading, offensive, defamatory or infringing content through any form on the Site, or submit someone else's personal information without their authority;
- interfere with or disrupt the Site or the servers or networks that host it, including by introducing malware or attempting a denial-of-service attack;
- attempt to gain unauthorised access to any part of the Site, its accounts, or any connected system;
- scrape, harvest, mine or systematically extract data or email addresses from the Site, or use automated means to submit forms;
- probe or test the vulnerability of the Site, or circumvent any security or rate-limiting measure; or
- copy, frame, mirror, resell or commercially exploit the Site or its content without our prior written consent.
6. Intellectual property
All content on the Site — including text, graphics, logos, the name "Netaye", layouts, designs, images and code — is owned by Netaye NZ Limited or our licensors and is protected by the Copyright Act 1994, the Trade Marks Act 2002 and equivalent laws elsewhere.
You may view the Site and print or download extracts for your own personal, non-commercial reference. All other rights are reserved. You must not reproduce, adapt, publish, distribute or use our content or trade marks without our prior written permission.
7. Feedback
If you send us ideas, suggestions or feedback about the Site or our product, you grant us a perpetual, irrevocable, worldwide, royalty-free licence to use it for any purpose without obligation, attribution or payment to you. Please do not send us anything you consider confidential or that you are not free to share.
8. Third-party links and services
The Site may link to or embed third-party websites and services. We do not control them, do not endorse them, and are not responsible for their content, availability or practices. Your use of them is at your own risk and subject to their terms.
9. Availability
We do not guarantee that the Site will be available, uninterrupted or error-free. We may modify, suspend or discontinue the Site or any part of it at any time without notice or liability.
10. Disclaimers
Subject to clause 11, the Site and its content are provided "as is" and "as available", and to the maximum extent permitted by law we exclude all warranties, conditions, guarantees and representations, whether express or implied, including as to accuracy, completeness, currency, fitness for purpose, merchantability, non-infringement, security and freedom from viruses.
11. Consumer rights (New Zealand)
Nothing in these Terms limits or excludes rights you have under the New Zealand Consumer Guarantees Act 1993, the Fair Trading Act 1986, or any other law that cannot lawfully be limited or excluded — including mandatory consumer protections in your own country.
Where you use the Site for the purposes of a business, you agree that the Consumer Guarantees Act 1993 and sections 9, 12A and 13 of the Fair Trading Act 1986 do not apply, and you acknowledge that it is fair and reasonable for the parties to be bound by this clause.
12. Limitation of liability
Subject to clause 11 — which prevails over this clause wherever they conflict — and to the maximum extent permitted by law:
- we are not liable for any indirect, consequential, special or incidental loss, or for any loss of profit, revenue, business, opportunity, goodwill, anticipated savings or data, however arising; and
- our total aggregate liability to you in connection with the Site and these Terms, whether in contract, tort (including negligence), equity, under statute or otherwise, is limited to NZ$100.
You are responsible for maintaining your own protections, including up-to-date anti-virus software and backups.
13. Indemnity
You indemnify us against all claims, losses, liabilities, costs and expenses (including reasonable legal costs) arising from your breach of these Terms, your misuse of the Site, or your breach of any law or third-party right.
14. Suspension and termination
We may restrict or block your access to the Site, and remove you from the waitlist, at any time if we reasonably believe you have breached these Terms or that doing so is necessary to protect the Site or other users. Clauses 6, 7, 10, 12, 13, 16 and 17 survive termination.
15. Privacy
We handle personal information as described in our Privacy Policy. Please read it before submitting any information through the Site.
16. Changes to these Terms
We may amend these Terms at any time by posting an updated version on the Site with a new "Last updated" date. Changes take effect when posted, and your continued use of the Site after that means you accept them. If a change is material we will make reasonable efforts to highlight it.
17. Governing law and jurisdiction
These Terms are governed by the laws of New Zealand. You and we submit to the non-exclusive jurisdiction of the courts of New Zealand. If you are a consumer resident outside New Zealand, this does not deprive you of the protection of mandatory consumer laws in your country, or of the right to bring proceedings in the courts of your country of residence where the law gives you that right.
18. General
- Severability — if any provision is found unenforceable, it is modified to the minimum extent necessary or severed, and the rest remains in force.
- No waiver — a failure or delay in enforcing a right is not a waiver of it.
- Assignment — you may not assign your rights under these Terms; we may assign ours to a successor of our business.
- Entire agreement — these Terms, together with the Privacy Policy and Cookie Policy, are the entire agreement between us about the Site.
- No agency — nothing in these Terms creates a partnership, agency or employment relationship between us.
- Force majeure — we are not liable for any failure or delay caused by events beyond our reasonable control.

This Cookie Policy explains how Netaye NZ Limited ("Netaye", "we", "us") uses cookies and similar technologies on netaye.com (the "Site"), and how you can control them. It should be read together with our Privacy Policy.
2. What cookies are
A cookie is a small text file placed on your device when you visit a website. Cookies let a site remember your actions and preferences, keep you secure, and — where used for that purpose — measure how the site is used.
We use "cookies" in this policy as shorthand for cookies and similar technologies, including local storage, session storage, pixels and tracking scripts, which work in comparable ways.
- First-party cookies are set by us; third-party cookies are set by another company whose service we use.
- Session cookies are deleted when you close your browser; persistent cookies stay until they expire or you delete them.

4. The cookies we use
Very few. We describe them by category rather than by individual cookie name, because the specific cookies our providers set can change without notice.
- Analytics — none. Our analytics are cookieless. They set nothing on your device, create no visitor or session identifier, and do not follow you across other websites. Visits are counted in aggregate only.
- Marketing and advertising — none. We do not use advertising cookies, and we do not allow third parties to set cookies on the Site for their own advertising purposes.
- Preferences — none. We do not store your settings or choices on your device.
- Strictly necessary — three. These are listed individually below. They keep the Site working and protect it from automated abuse. None of them are used for analytics or advertising, and none are used to build a profile of you.

All three are first-party cookies, set on our own domain rather than by an outside advertiser. None of them store your name, email address or any other detail you have given us.

5. Your consent
We do not use any cookie that requires your consent, so the Site shows no cookie banner. The one strictly necessary cookie described above is set automatically, because the Site cannot be kept secure without it.
If we later add analytics, preference or advertising cookies that require consent, we will ask you before setting them, give you a way to change your mind, and update this policy first.
New Zealand has no separate cookie-consent statute, but placing a cookie on your device involves collecting information about you, so we treat it as a matter covered by the Privacy Act 2020 and by this policy. We ask before setting anything that is not strictly necessary.
6. Managing cookies in your browser
You can block or delete cookies through your browser settings at any time. Blocking strictly necessary cookies may stop parts of the Site working, including the sign-up form.
Most browsers also offer a private or incognito mode that discards cookies when the window closes.
7. Do Not Track and Global Privacy Control
Browsers may send a "Do Not Track" (DNT) or "Global Privacy Control" (GPC) signal. There is no consistent industry standard for responding to DNT, so the Site does not respond to it.
GPC is a signal asking that your personal information not be sold or shared. We do not sell or share your information, and our analytics neither identify you nor track you across other websites, so there is nothing for that signal to change.
